Appellate Court Affirms Dismissal of Employer from Vehicle Accident Suit

King Roy and Aaron LaRue secured dismissal of a Will County case involving multiple plaintiffs allegedly injured in an motor vehicle accident. They successfully argued that the scope of agency of the defendant-driver, who was an employee of P&W's client at the time of the accident,  had terminated once he left the employer's premises. The plaintiff appealed, and the Appellate Court affirmed the dismissal order in Veldhuizen v. Eppenstein, 2016 IL App (3d) 160095-U. The court held that the employer could not be held liable under a theory of respondeat superior when he was outside the scope of his employment.
