King Roy was recently quoted in an article titled, “Trucking Broker, Texas Cucumber Co. Escape Legal Pickle,” that appeared in Law360 on January 18, 2019. The article reported on the recent Illinois Appellate Court opinion affirming the dismissal of claims against a P&W client, in an underlying vicarious liability case.
In the underlying case, Texana Pickle Producers Inc., represented by Michael Sanders and King Roy, was accused, along with other companies, of negligently hiring a trucking company to haul its load to a plant based in Illinois. After delivery, the tractor-trailer was involved in a collision that caused severe injuries to the plaintiff.
The appellate court stated that “no Illinois court has ever ruled that a negligent hiring claim is valid when the injury occurred … after the completion of the contracted-for work.”
The appellate court originally released the opinion in late December 2018, but certified it for publication on January 17, 2019.
