Brad Purcell & Emily Schnidt obtained summary judgment for a village and its police officer in a Cook County case brought by a plaintiff who had been charged with and indicted for retail theft. In early 2015, the court dismissed the plaintiff's claims that the village and police officer had falsely arrested or falsely imprisoned the plaintiff, finding that the defendants had had probable cause to arrest the plaintiff. Just before the scheduled 2016 trial date, the court also granted summary judgment to the defendants on the plaintiff's remaining claims. P&W successfully argued that probable cause defeated the plaintiff's claims of malicious prosecution, and that the defendants' conduct was not extreme and outrageous as the plaintiff's claim for intentional infliction of emotional distress required.
